For TKW CARGO, LDA, the confidentiality and integrity of the personal data of its associates, partners, customers or suppliers is one of our concerns. The use of this data will be used for clearly identified purposes and in accordance with the European Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to processing of personal data and the free movement of personal data.

1. PURPOSE OF PERSONAL DATA COLLECTED BY TKW CARGO, LDA

TKW CARGO, LDA requires the holder of personal data, free, specific, informed and explicit consent for the treatment of various categories of personal data, in accordance with the requirements of its activity, legal basis, or activity of its partners, namely within the scope of compliance with legal imperatives and projects of a public nature, contractual or pre-contractual relations, audits, integrity and safety of facilities and equipment, management of commercial relations or for communication and marketing purposes.

Although there is always a risk that data may circulate without security conditions, TKW CARGO, LDA has an internal process of continuous and updated registration of the personal data processing activities it carries out, in order to avoid loss, misuse, alteration, unauthorized access or misappropriation of personal data provided by the holders, without prejudice to the fallibility of Internet security measures.

Personal data are only kept for the period in which they are necessary within the scope of the purpose for which they were collected, or at the request of the respective holder, after which they will be anonymized or destroyed.
In cases where there is a period of retention of data imposed by law, the right to erasure can only be exercised after this period has expired.

3. PERSONAL DATA HOLDER’S RIGHTS

Without prejudice to the previous point, the holder of personal data has the right to request from TKW CARGO, LDA access, rectification or erasure of their data, as well as the limitation or portability to other entities.
In cases where there is a period of retention of data imposed by law, TKW CARGO, LDA reserves the right not to execute the request, clarifying the holder of the personal data of the respective basis to the interested holder.
The holder of personal data may file a complaint or exposure with the National Data Protection Commission (CNPD), as the Control Authority in Portugal.

4. TRANSMISSION OF PERSONAL DATA TO THIRD PARTIES

TKW CARGO, LDA, in the course of its activity, and after prior consent of the holders of personal data in compliance with the requirements set out in the Data Protection Regulation, may transmit them to third parties, as defined in number 10 of article 4 of the RGPD, in fulfillment of legal, regulatory, pre-contractual or contractual duties, namely to public authorities responsible for control and audit assignments and/or to partners of activities, projects or services.
Likewise, TKW CARGO, LDA may, in the course of its activity, subcontract other entities to process personal data on its behalf, after prior consent of the holders of personal data in compliance with the requirements set out in the Data Protection Regulation

5. DATA COLLECTED THROUGH OTHER TECHNICAL MEANS

TKW CARGO, LDA additionally collects anonymous information through its Website, namely information regarding the type of browser, operating systems, location, IP, date and time of access to the website, using technologies to control this information, namely through google analytics. Any personal data that can identify you individually in relation to the use of the Website is not stored”.

6. RESPONSIBLE FOR PROCESSING PERSONAL DATA

TKW CARGO,LDA is responsible for the collection, treatment, conservation, anonymization and/or elimination of personal data of its partners, customers or suppliers.
Any question regarding the use of personal data should be submitted to the email address chespanhol@tkw.grupoidb.pt, or by letter addressed to TKW CARGO, LDA to the address indicated in the header of this document.
Under the terms and deadlines provided for in article 33 of the RGPD, TKW CARGO, LDA undertakes to notify the CNPD, if it becomes aware of any event of violation of personal data, as defined in number 12 of article 4 of the RGPD.
